{"id":4144,"date":"2024-05-30T13:01:39","date_gmt":"2024-05-30T13:01:39","guid":{"rendered":"https:\/\/myavis.lt\/avisnow\/rules-for-handling-consumer-complaints\/"},"modified":"2024-11-20T20:24:38","modified_gmt":"2024-11-20T20:24:38","slug":"rules-for-handling-consumer-complaints","status":"publish","type":"page","link":"https:\/\/myavis.lt\/en\/avisnow\/rules-for-handling-consumer-complaints\/","title":{"rendered":"Rules for handling consumer complaints"},"content":{"rendered":"<div class=\"row\"  id=\"row-1739604076\">\n\n\n\t<div id=\"col-1166023991\" class=\"col small-12 large-12\"  >\n\t\t\t\t<div class=\"col-inner\"  >\n\t\t\t\n\t\t\t\n\n<h1><span data-text-color=\"primary\">Rules for handling consumer complaints<\/span><\/h1>\n<table>\n<tbody>\n<tr>\n<td width=\"321\">\n<p><span style=\"font-size: 110%;color: #000000\">The Rules of Consumer Complaints Handling (hereinafter &#8211; the <strong>Rules<\/strong>) provide for the procedures for handling complaints submitted by consumers UAB LITIDEAL, company code: 111444388, address: Laisv\u0117s pr. 3, Vilnius, Lithuania, el. p. avisnow@avis.lt (hereinafter &#8221; <strong>LITIDEAL<\/strong>&#8220;).<\/span><\/p>\n<p> <\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"321\">\n<p><span style=\"font-size: 110%;color: #000000\">Terms used in the Rules:<\/span><\/p>\n<p><span style=\"font-size: 110%;color: #000000\"><strong>Customer<\/strong> &#8211; a natural person (consumer) to whom LITIDEAL provides services for his\/her personal purposes.<\/span><\/p>\n<p><span style=\"font-size: 110%;color: #000000\"><strong>Complainant<\/strong> &#8211; an existing or potential Customer who has lodged a Complaint in relation to the services provided by LITIDEAL and\/or the contracts concluded with LITIDEAL.<\/span><\/p>\n<p><span style=\"font-size: 110%;color: #000000\"><strong>Complaint<\/strong> &#8211; a written appeal by the Applicant to LITIDEAL on the grounds that the Applicant&#8217;s rights or legitimate interests have been violated in relation to the services provided by LITIDEAL to the Applicant\/contracts concluded, and requesting that the Applicant&#8217;s claims be satisfied.<\/span><\/p>\n<p> <\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"321\">\n<p><span style=\"font-size: 110%;color: #000000\">Claimants who believe that LITIDEAL has violated their rights or legally protected interests in connection with the provision of LITIDEAL&#8217;s services must first contact LITIDEAL in writing, stating their claims and the circumstances of the dispute (unless the consumer applies directly to the court). The applicant must contact LITIDEAL in writing no later than within 3 months from the date on which he\/she became aware or should have become aware of the infringement of his\/her rights or legitimate interests.<\/span><\/p>\n<p> <\/p>\n<p><span style=\"font-size: 110%;color: #000000\">The complaint can be submitted in English or Lithuanian.<\/span><\/p>\n<p> <\/p>\n<p><span style=\"font-size: 110%;color: #000000\">In addition to the Applicant, the Complaint may also be submitted by a duly authorised representative of the Applicant, in accordance with the procedure laid down by law.  <\/span><\/p>\n<p> <\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"321\">\n<p><span style=\"font-size: 110%;color: #000000\">The applicant may submit his\/her Complaint in the following ways:<\/span><\/p>\n<p><span style=\"font-size: 110%;color: #000000\">&#8211; by sending the signed Complaint to LITIDEAL&#8217;s registered office at the address set out in these Rules above,<\/span><\/p>\n<p><span style=\"font-size: 110%;color: #000000\">&#8211; by sending the Complaint, signed with LITIDEAL&#8217;s electronic signature, by email to. to the postal address indicated in these Rules above.<\/span><\/p>\n<p> <\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"321\">\n<p><span style=\"font-size: 110%;color: #000000\">The complaint must state:<\/span><\/p>\n<p><span style=\"font-size: 110%;color: #000000\">&#8211; The applicant&#8217;s name, date of birth or personal identification number and a contact address for communication;<\/span><\/p>\n<p><span style=\"font-size: 110%;color: #000000\">&#8211; The date of the complaint and the reason for the complaint, i.e. what rights\/interests have been infringed;<\/span><\/p>\n<p><span style=\"font-size: 110%;color: #000000\">&#8211; how you want the infringement to be remedied;<\/span><\/p>\n<p><span style=\"font-size: 110%;color: #000000\">&#8211; attach documents (if any) to support the facts set out in the Complaint;<\/span><\/p>\n<p><span style=\"font-size: 110%;color: #000000\">&#8211; how you want to receive the answer;<\/span><\/p>\n<p><span style=\"font-size: 110%;color: #000000\">&#8211; signature (The complaint must be signed).<\/span><\/p>\n<p> <\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"321\">\n<p><span style=\"font-size: 110%;color: #000000\">The complaint shall be investigated and a detailed, reasoned written reply shall be provided to the Complainant no later than 14 days from the date of receipt of the Complaint (or receipt of revised information, as applicable).<\/span><\/p>\n<p> <\/p>\n<p><span style=\"font-size: 110%;color: #000000\">In the event of failure to provide the above information or incomplete information, the time limit for the examination of the Complaint will only start to run after the Applicant has complied with the request for clarification.<\/span><\/p>\n<p> <\/p>\n<p><span style=\"font-size: 110%;color: #000000\">Complaints are investigated free of charge.<\/span><\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"321\">\n<p><span style=\"font-size: 110%;color: #000000\">The complaint shall be examined in accordance with the principles of justice, fairness, impartiality and reasonableness, and shall be subject to a full examination of the facts set out in the complaint.<\/span><\/p>\n<p><span style=\"font-size: 110%;color: #000000\">The reply to the Applicant&#8217;s Complaint shall be given in writing, in the same manner as it was received, unless the Applicant has indicated a preference for a different method of reply at the time of lodging the Complaint. The reply shall be in the language (Lithuanian or English) in which the Complaint was submitted.<\/span><\/p>\n<p> <\/p>\n<p><span style=\"font-size: 110%;color: #000000\">LITIDEAL shall have the right to refuse to process anonymous, unsigned and illegible Complaints or Complaints that do not contain sufficient identifying data of the Complainant. LITIDEAL shall have the right not to consider repeated Complaints. i.e. such Complaints with which the same Applicant addresses LITIDEAL on the same issue.<\/span><\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"321\">\n<p><span style=\"font-size: 110%;color: #000000\">If LITIDEAL does not satisfy the Applicant&#8217;s claims or satisfies them partially, LITIDEAL shall provide a detailed reasoned written reply, indicating other remedies for the Applicant&#8217;s interests.<\/span><\/p>\n<p><span style=\"font-size: 110%;color: #000000\">If the Applicant is not satisfied with LITIDEAL&#8217;s reply or if he\/she has not received a reply within 14 days, the Applicant shall have the right to apply to a consumer dispute resolution body within 1 year from the date of the application to LITIDEAL.<\/span><\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\n\t\n\n<\/div>","protected":false},"excerpt":{"rendered":"","protected":false},"author":5,"featured_media":0,"parent":3245,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"_acf_changed":false,"om_disable_all_campaigns":false,"footnotes":""},"class_list":["post-4144","page","type-page","status-publish","hentry"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v24.6 -
